Can false allegations of domestic violence lead to legal trouble?

On Behalf of | Aug 13, 2025 | Criminal Defense

False claims of domestic violence in Florida can wind up backfiring on the person who makes them. You could face many serious consequences if you knowingly report something untrue.

Criminal penalties for false reports

Florida law makes it a crime to knowingly lie to police about a felony or misdemeanor. Under Florida Statute § 817.49, knowingly filing a false police report is a first-degree misdemeanor. You can be punished with up to 12 months in jail, 12 months of probation, and fines up to $1,000. If the false claim involves abuse of a child or an adult, that offense becomes a third-degree felony, punishable by up to 5 years in prison and fines up to $10,000.

Injunctions and court-ordered consequences

When false statements are used to back a petition for protection from domestic harm, courts can impose costs and attorney’s fees on the person who made the claim. Under Florida Statute § 57.105, the respondent can be forced to pay fees if the petition is found to be frivolous or filed in bad faith. Those consequences serve as a corrective measure when claims appear weaponized.

Civil liability: defamation and malicious prosecution

You may also be on the hook for damages under defamation or malicious prosecution. A false statement accusing someone of a crime may qualify as defamation per se. That means plaintiffs don’t have to prove harm to recover damages . Additionally, someone can file a claim for malicious prosecution if you pursued charges without a proper legal basis or probable cause.

Impact beyond courtrooms

False claims can have serious real-world fallout: arrests, removal from shared housing, temporary court orders, and disruption in employment or child custody situations—as seen in many family law disputes Verywell Mind+1Law Offices of Dave L. Holding false claimants accountable

Florida law is designed to deter misuse of the legal system. Criminal statutes allow prosecution of someone who knowingly makes false claims. Courts handling protection orders can impose penalties. Civil laws offer additional remedies through defamation and malicious prosecution claims.

By setting meaningful legal and financial consequences, Florida law aims to discourage false reporting and protect those who are falsely accused.
