Can you expunge a domestic violence conviction in Florida?

On Behalf of | Jul 29, 2025 | Criminal Defense

A conviction for domestic violence leaves lasting repercussions that extend well beyond the resolution of your case. You might wonder whether Florida law gives you any opportunity to clear your record and move forward. While expungement may sound like a clean slate, Florida law sets clear limits on who qualifies and under what circumstances.

What is expungement in Florida?

Expungement destroys your criminal record, removing it from most employers’ and agencies’ background checks. Florida also offers record sealing, which hides the record from public view without destroying it. These legal options help people whose charges did not result in a conviction and who meet strict eligibility guidelines.

Can a domestic violence conviction be expunged?

Florida law does not allow anyone to expunge or seal a domestic violence conviction. If a court finds you guilty—even with a withheld adjudication—the record stays. This rule applies whether the incident involved a spouse, partner, or family member. Lawmakers consider these offenses serious and keep them accessible in public records. Because of this, your conviction remains visible to employers, landlords, and licensing boards.

Are there any exceptions?

You may qualify for expungement only if the court dropped your case, dismissed it, or issued a not-guilty verdict. In those cases, you can petition to expunge the arrest record. However, once you receive a conviction of any kind, even one with a withheld adjudication, Florida law blocks expungement. The law leaves little room for exceptions in domestic violence cases, even if the court imposed minimal penalties.

If you cannot expunge your conviction, focus on how you present your background. Some employers consider context when reviewing criminal records, especially if you have shown consistent growth since the offense. You may also seal other unrelated charges if they qualify under the law. Although a domestic violence conviction stays on your record, it does not stop you from rebuilding your life and moving forward with purpose.
